Terms of Service
These Terms of Service ("Terms") govern your access to and use of XBuddy's products and services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any XBuddy service, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2. Account Registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at security@xbuddy.co.
3. Subscription and Billing
XBuddy offers subscription plans billed monthly or annually. Your subscription automatically renews unless cancelled before the renewal date. Refunds are available within 14 days of initial purchase for annual plans. Module add-ons and token top-ups are non-refundable once consumed. Prices are subject to change with 30 days' notice.
4. Acceptable Use
You may not use XBuddy for any unlawful purpose or in violation of any applicable laws. You may not attempt to gain unauthorized access to any portion of the service, interfere with or disrupt the integrity or performance of the service, or upload malicious code. You may not resell or sublicense access to the service without our written permission.
5. Data Ownership
You retain ownership of all data you input into XBuddy. We do not claim any intellectual property rights over your data. We will not use your data to train AI models or share it with third parties without your consent. Upon account termination, you may export your data for 90 days before it is permanently deleted.
6. Service Availability
We strive to maintain 99.9% uptime for our services. Scheduled maintenance windows will be communicated in advance. We are not liable for damages arising from service interruptions beyond our reasonable control, including but not limited to force majeure events, third-party infrastructure failures, or denial-of-service attacks.
7. Limitation of Liability
To the maximum extent permitted by applicable law, XBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amounts paid by you in the 12 months preceding the claim.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Vietnam. Any disputes arising under these Terms will be resolved through binding arbitration in Ho Chi Minh City, Vietnam, unless both parties agree otherwise.
